Terms of Service

These Terms of Service ("Terms") govern your access to and use of PartyNestPlan (the "Service"). PartyNestPlan is operated as a sole proprietorship based in Luxembourg ("we," "us," "our"). Full trader identity is available upon request to info@partynestplan.com, as required by applicable consumer protection law. By purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PartyNestPlan is a digital service that generates personalized children's birthday party plans delivered as downloadable PDF documents. Plans are generated using artificial intelligence based on inputs you provide (such as child's name, age, interests, group size, party duration, and theme).

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to purchase the Service. By purchasing, you represent that you meet these requirements and that you are the parent, guardian, or authorized person acting on behalf of the child whose information you provide.

3. Purchase and Payment

Prices are displayed in US dollars (USD) unless otherwise stated. Payment is processed securely by Stripe, Inc. We do not store your full payment card information. By completing purchase, you authorize us (through Stripe) to charge the amount shown at checkout.

4. Immediate Digital Delivery — Waiver of Withdrawal Right

Your party plan PDF is generated and delivered immediately upon successful payment. By completing purchase, you expressly consent to immediate performance of the Service and acknowledge that you lose your right of withdrawal under Directive 2011/83/EU, Article 16(m), once delivery has begun. This waiver is standard for digital content delivered instantly and is confirmed by the checkbox at checkout.

5. License and Permitted Use

Upon purchase, we grant you a personal, non-exclusive, non-transferable, non-commercial license to:

• Download, print, and use the generated PDF for your own family's birthday party
• Share the PDF with direct collaborators helping you host that specific party (e.g., co-parent, babysitter)

You may not:

• Resell, redistribute, or publicly share the PDF
• Upload it to file-sharing sites, template marketplaces, or public forums
• Use it for commercial purposes (e.g., paid party planning services)
• Use automated means to bulk-generate plans for redistribution
• Reverse-engineer the Service to extract the underlying activity library or prompt logic

6. Intellectual Property

All content of the Service — including the activity library, generation engine, prompt architecture, visual design, branding, and the PartyNestPlan name — is owned by us and protected by copyright and other intellectual property laws. The PDFs you purchase are licensed to you under Section 5, not sold.

7. AI-Generated Content — Disclaimer

Party plans are generated using AI (large language models). While we curate the underlying activity library and tune the generation carefully, AI output can occasionally include errors, inconsistencies, or suggestions that require parental judgment to adapt. You are solely responsible for:

• Reviewing the plan before the party
• Assessing age-appropriateness and safety for your specific child and guests
• Supervising all activities
• Making substitutions where needed

The Service is provided "as is" and "as available" without warranty of fitness for any particular purpose.

8. Child Safety

Activities suggested in our plans are designed for home or low-risk party settings with adult supervision. You are the sole responsible adult for all safety decisions, allergy considerations, food choices, and supervision during any party based on our plans.

9. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability for any claim arising from or related to the Service is limited to the amount you paid for the specific plan giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including but not limited to loss of enjoyment, loss of opportunity, or damages arising from reliance on AI-generated suggestions.

Nothing in these Terms limits liability that cannot be limited under applicable law, including statutory consumer rights in the European Union.

10. Refunds

All sales are final. See our Refund Policy for full details and narrow exceptions (e.g., duplicate charges, non-delivery due to technical failure).

11. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its backend
• Submit input designed to manipulate the AI to produce harmful, illegal, or inappropriate content
• Use the Service to generate plans involving minors in a non-parental/non-guardian context

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time; Sections 5, 6, 7, 9, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of Luxembourg City, Luxembourg. If you are a consumer resident in the European Union, you retain all mandatory protections granted by the consumer protection laws of your country of residence. If you are a consumer resident in the United States, nothing in this section waives statutory rights under applicable state consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect changes. Material changes will be communicated via the Service or by email if we have your address. Continued use after changes constitutes acceptance.
